In response to BREXIT

PEKAES has been following the status negotiations between the European Union and the United Kingdom on the so-called BREXIT.

As the leading logistic operator, we have considerable experience among other things in the transport and customs service for goods transported between the European Union and third countries, i.e. countries that are not members of the EU. Our team of customs specialists has knowledge and long-term practice in applying customs law regulations. At the same time we would like to assure you that we have all necessary permits and procedures necessary to handle the goods trade with countries that are not members of the EU.

Because one of the possible scenarios is the so-called “hard exit” of the United Kingdom from the European Union as of 29 March 2019, we would like to give you the basic information concerning the goods trade between the EU and the UK already today.

In the case of the so-called hard Brexit, starting from 30 March 2019, customs authorities of the EU Member States will apply EU regulations concerning exports to and imports from the United Kingdom in the same way that they apply them in relation to third countries. This will means an immediate change in procedures and end of free movement of goods. Therefore, it will become necessary to fulfil standard customs formalities, including the obligation to: register in the e-Client service (obtain the EORI number), submit customs declarations, and pay customs and tax duties connected with the imports of goods.

Regardless of the outcome of negotiations concerning Brexit, the PEKAES Group is prepared for the imminent changes and for supporting our Customers in efficient provision of transport services.

List of the most important activities to be carried out by the importer:

• registration in the e-Client service ( https://puesc.gov.pl/web/puesc/eori ) and receiving the EORI number, meeting this requirement will make it possible to conduct the customs clearance,
• selection of the customs procedure (import, special procedures),
• if necessary – obtain the customs permit for the importing of goods,
• determining the method of submitting the declaration (e.g. via a customs agency – the power of attorney must be granted),
• determining the goods classification (
https://ext-isztar4.mf.gov.pl/taryfa_celna/ ). These codes are used in customs declarations and ensure the calculation of the correct customs duty,
• paying customs duties and taxes due.

List of the most important activities to be carried out by the exporter:

• issuing the invoice and, if necessary, specification.

Commercial invoice:

The invoice attached to the customs declaration should contain:
• counterparty’s name and address,
• buyer’s name and address,
• number,
• place and date of issuance,
• type and quantity of goods and their value in the currency,
• currency,
• terms of delivery – for example based on the Rules of the International Chamber of Commerce – INCOTERMS 2010,
• other data, if required.

EORI (Economic Operators Registration and Identification) number:

The EORI number is used for the purposes of identification of economic operators in contacts with customs and tax authorities within the territory of the entire European Union.
